Background

These Terms and conditions (“Terms”) govern your access to and use of our Services, interaction and engagements including visits by you on our various portals, websites, SMS, APIs, email notifications, applications, registration, buttons, widgets, ads, exhibitions, contests and Awards and our other covered services that link to these Terms (collectively, the “Services”), and any information, text, graphics, photos or other materials uploaded, downloaded or appearing on the Services (collectively referred to as “Content”). Your access to and use of the Services are conditioned on your acceptance of and compliance with these Terms. By accessing or using the Services you agree to be bound by these Terms.
We kindly request you to read these terms carefully and please also note that we may, from time to time amend these terms. Such amendments will be made available to the users on the website and become binding as updated. By continuing to use our services the user accepts the amended terms. The current term has been published and applied as of 6th day of September 2021(hereinafter effective Date)

Introduction

Happening late this year from 6th to 10th Dec 2021, Kenya Innovation Week is a flagship innovation forum for the country run by the Kenya National Innovation Agency. It seeks to showcase the innovativeness of Kenyans under which the national priorities of the Big 4 Agenda and Vision 2030 will be advanced. It will champion relevant policy engagements on innovations within institutions while promoting practical skills necessary to create innovations that impact people. In addition, Kenya Innovation Week will strengthen the research and commercialisation practices for greater socio-economic impact. To achieve its objectives, Kenya Innovation Week 2021 will convene the local governments, private sector, development partners, media and civil society in order to capitalize in as much shared value as possible.

Use Of Our Service

  1. Users
    Our services and contents can be accessed and used by an individual in their own capacity, or as an authorized representative of a legal entity or a representative acting for another.
  2. Eligibility Criteria
    1. Individual or person acting as a representative for another or any legal entity in relation to access and use of our service and or content Must have login credentials, a duly registered user account.
    2. A single account may be used to access and use our services and or content.
    3. The User shall be able and willing to influence, promote innovation individually or in partnership with others or through representatives.
    4. Users shall be an enthusiast of science, research and innovations and passionately seek innovative ideas and startups to modify, improve and or to incubate.
    5. User be a person, body or body of persons with innovative ideas that is able and willing to work with KeNIA either as an investor, partner and any other capacity KeNIA deems fit to access and use our service.
  3. Accounts
    To be a user of our service, without prejudice to the foregoing generalities, any person who wishes to associate by way of access or use of our service and content should have an account by way of registration, when registering the user shall provide accurate and complete registration data. In addition to the aforementioned, the online registration is deemed to have been duly completed if it does not infringe trademarks and fulfils two of the Eligibility criteria set forth.
  4. User rights
    Subject to due registration and in compliance with these terms and conditions, KeNIA grants our users a limited, non-exclusive, non-transferable and non-sublicensable rights to access and use our services and or content. Specifically, KeNIA allows users to create events, participate in events, partner and add session ideas. Such granted rights shall be valid for as long as user access and use our service and or content in compliance with the terms. KeNIA reserves the right to terminate and remove a user account at any time, in case KeNIA deems that the user has breached the terms, added misleading, inaccurate, unauthorized or illegal content to our services, or caused harm to KeNIA or users of services. We are continuously developing our services and we may, from time to time at our sole discretion, change, modify or remove any of our services, including any functionalities and features in parts and or in whole and without notifying you thereof.
  5. Users restrictions
    The user having a user account is not permitted nor entitled to do any of the following:
    1. Transmit any unauthorized advertising, promotional materials, junk mail, spam, chain letters, contests, pyramid scheme or any other form of solicitations or mass messaging.
    2. Use the user account in violation of applicable laws
    3. Use the account in ways that violate the intellectual property rights, confidential information, business secrets, trade secrets or privacy of third parties.
    4. Use the account to transmit any material that may contain adware, malware, spyware, software viruses, worm or any other computer code designed to interrupt, destroy, or limit the functionality of computer software or equipment.

Resource Mobilization

KeNIA as a state corporation is guided by principles and framework of public finance as espoused in (the chapter 12) of the Constitution of Kenya 2010.KeNIA firmly believes in an open, transparent, accountable and prudent use, utilization and absorption of public resources. Without prejudice to the foregoing generalities, KeNIA does not in any way intend to create a legally binding financial relationship with users and or you. The aforementioned notwithstanding, the terms herein below succinctly speaks to financial obligation in respect to access, use of our services and or content.

  1. Cost sharing
    KeNIA may in partnership with you commit reasonable and adequate necessary resources and incur the legal, accounting and incidental expenses to properly cater for a project, event or any other expenses. The cost may be shared subject to the availability of the resources and to the greatest extent the fund may facilitate the success of the project at the minimum cost possible. The partner shall transfer the agreed amount to the other without undue delay to the agreed account.
  2. Contribution’s Expenditure, Utilizations and Absorption of funds Proceeds made
    The parties shall at least before the start of the project furnish with the other estimates for expenditure, the blueprints of the project in question highlighting why the cost should be shared, benefits to the general public in light of science, research and innovation and detailed budget of each and every item duly signed by the user. Money shall be spent on the subject matter at a reasonable possible time and audit the account at the end of the project and be made available to both parties.
  3. Proceeds made out of commercialization of Ideas, Expenditure, Utilizations and Absorption of funds
  4. Audit

Governing Laws

These terms shall be governed by the Constitution of Kenya 2010, Industrial property Act, the trademark Act, Science, Technology and Innovation Act, Copyright Act and all other relevant laws of Kenya except where otherwise expressly provided.

Awards

All the foregoing notwithstanding, this part specificapplication for, evaluation of, Notification of and awardfor the national innovation awards 2021 Categories of the National Innovation Awards There shall be only three categories of awards:

  1. THE BIG 4 AGENDA
  2. THE GOVERNMENT AGENCIES
  3. THE ASSISTIVE TECHNOLOGY
All of the above mentioned categories to be applied for by potential innovative general public subject to the following eligibility criteria, except for the assistive technology category earmarked for innovators whose innovation aims at ‘assisting’ the minorities i.e. the person living with disabilities (PWDs), the senior citizens and such other group the jury /or evaluation committee may deem minority.
Eligibility criteria to apply for consideration for the Awards.
The applicant(s) for the national innovation awards:
  1. Must have a duly registered account with KeNIA and have fully participated in the KIW 2021. Through which the applicant must submit accurate data online for consideration of their application.
  2. Have made the application within the set time frame from when the call for this award (national innovation award) has been announced.
  3. Have the legal status, aptness, reputation and capacity to have the jury consider your application.
  4. Provision in the previous subsection notwithstanding applicant MUST show:
    1. originality,
    2. novelty,
    3. relevance,
    4. applicability,
    5. acceptability,
    6. usefulness,
    7. sustainability,
    8. environmental friendliness of their innovation and or idea etc.
  5. 5.Applicant to espouse a comprehensive write up and/or clarity in delivery of the requirements set out in subsection 4.

Evaluation of the applicants for Awards
There shall be a jury and/or evaluation committee to analyse the application, who upon due consideration shall notify you of the status of your application.
Awards of the Winners
The Kenya National Innovation Agency will award three successful applicants(Winners) for each categories in the following order:
  1. Winner
  2. Runners-up
  3. Second runners-up

The applicants who are successful may be awarded in cash(cheque), vouchers, Certificates and/or any other goodies the juries may deem fit on the close of KIW 2021.
The amount, date, venue for the same to be separately communicated to the winners.

Amendments and Termination

Amendments.
Access and use of our service might be amended from time to time, such amendments will be made available to the users on the website (INSERT WEBSITE) and become as applicable and binding as updated. The amendments will pop up on the screen in the course of your visit to the website to access or use our service and or content and will request you to ‘update terms and conditions’ and unless you agree to terms, may not be binding. While requesting users to update the terms and conditions the access and use of our service and or content may partially/temporarily be eclipsed.
Termination
The access and use may be terminated in the events the ideas and or the innovations conflict the above set criteria, or are in conflict with the terms and conditions , are in conflict with the strategic objective, mission and vision of KeNIA, disorients local content, morals, induces corrupt practices in influences or promotion of ideas and potentially lead to any undesired outcome, disregards gender parity in any form or shape, entrenches discrimination of whatever form against a given gender or PWDs, highly exposes the privacy of individual or state and thus a threats national security/cohesion.

Resolution Clauses

Any disputes, controversy or claim arising out of or relating to access and use of our services and contents and or terms herewith or the breach, termination or validity thereof shall be subject to amicable negotiation between you/user and KeNIA.
If the user in whatever capacity (individual /representative/legal entity) feels aggrieved or dissatisfied with the outcome of the out-of -court settlements he or she is at liberty to institute a suit in the courts of competent jurisdictions.
The court in resolving the disputes, controversy or claim arising out of or relating to access and use of our services and contents and or terms herewith or the breach, termination or validity shall make reference to this term and adopt a purposive interpretation and render justice to the aggrieved parties.

Miscellaneous

These terms only cover access and use of our services and any linked third party services and platform are covered separately by their terms and conditions.
KeNIA does not assume any liability with regards to access and use of such third party services and contents.
No agency, partnership, or employment is to be created as a result of these terms and conditions.

Privacy Policy

Background and Purpose

Kenya National Innovation Agency (KENIA) (hereinafter referred to as “BOARD’’ or “we’’) is a body corporate established under section 28 of the Science, Technology and Innovation (STI) Act of 2013.KENIA is mandated to develop and manage a vibrant and dynamic national innovation system.
In connection with our operations and to be able to execute our mandates of developing a dynamic national innovation system, achieve our vision to be a key enabler of social-economic growth through commercialization of innovations, taking ideas to the market and in light of Kenya’s Vision 2030 and the Big Four Agenda we intend to conduct Kenya innovation week (KiW) where we may collect, use and process personal data of you as a user of our services and /or contents.
This privacy policy would serve to inform the public, stakeholders, partners and all other persons (hereinafter referred to as “user” or “you”) about what data is being collected, why it is being collected and how it’s being processed, stored and used. All of the aforementioned will be premised on the following parameters: User notifications, legality, legitimacy, due process, purpose specific, adequacy and proportionality.
For the purpose of this privacy policy, our services refer to all forms of interactions/ engagements including and not limited to interactions on the KENIA’s website (insert correct website), the Kenya Innovation Week (KIW 2021), exhibitions, trainings, seminars, workshops, bootcamps, pitching competitions, webinars, hackathons and all other events we will have you on board.

Personal Data

Our user’s personal data collected and processed by us in connection with our services and or content can be divided into two general data categories: “user data” and “technical data” (including cookies and web analytic). Further, we may also process your personal data in connection with recruitment process. These data categories are explained in more details below.

Use of Data

User data is a personal data that is collected directly from you, or from us in connection with access and use to our service and or content. This can happen under the circumstances such when user registers, create a profile with us, accordingly the user data necessary when registering with KeNIA:

  2. Last name
  3. Email address
  4. Password
  5. And opt in and opt out to access and use of our service and/or content.

Technical Data

We do not normally use technical data to identify you as an individual, but you can sometimes (e.g. in certain technical support cases) be recognized from such data, either alone or when combined or linked with user data.in this situations, technical data can also be considered personal data under applicable laws and we shall treat such data as personal data.
We and our authorized third party service providers may automatically collect the following technical data when you visit or interact with our services and or content:

  2. Device and device identification number
  3. Time spent at our services
  4. Interaction with our services
  5. URL of the website you visited before and after visiting our website
  6. IP address and
  7. Operating system and the internet service provider utilized.

Users' Rights

  • Right to access

    The users have the right to access the personal data relating to them and processed by us. We give you possibility to view certain data through your account as registered with KeNIA or request a copy of your personal data.

  • Right to object

    If the data is being processed against any of the following grounds: User notifications, legality, legitimacy, due process, purpose specific, adequacy and proportionality you may have right to object to the further processing of your personal data. This may lead to fewer possibilities to access and use of our service and or content.

  • Right to rectify

    The users have the right to have incorrect, imprecise, incomplete, outdated or unnecessary personal data we have stored about the user corrected or completed by contacting us, or update through user account.

  • Right to erasure

    The user may also request us to delete their own personal data from our system unless it breaches the laid down parameters such as: user notifications, legality, legitimacy, due process, purpose specific, adequacy and proportionality.

  • Right to data portability

    In certain situations, you may have rights to receive your personal dat from us in a structured and commonly used format and to independently transmit the data in question to a third party.

  • Right to withdraw consent

    In case the processing is based on a consent granted by the user, the user may withdraw the consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on a consent before its withdrawal.

  • Right to restriction of processing

    You may request us to restrict processing of personal data, for example, when your data erasure, rectification, or objection request are pending and /or when we do not have legitimate grounds to process your personal data. However, this may lead to fewer possibilities to access and use of our services and or content.

Recepients and Data Disclosure

We only share personal data within our KeNIA, if and as far as reasonably necessary, for the purposes of this privacy policy, we do not share personal data with third parties outside KeNIA unless one of the following circumstances applies:

    To the extent third parties such as other KeNIA users and KIW participants, side event’s organizers safaris, or other partners need access to your personal data in order for us to perform our services. KeNIA has taken the appropriate contractual and organizational measures to ensure your data are processed exclusively for the purposes specified in this privacy policy.
